UK Visa Refusal

I got a package from UK VAC via 2go last friday. It was my passport and other docs that I’ve submitted to them. I was very disappointed and depressed after reading the letter of refusal. Unfortunately, my visa was refused for the following grounds according to Entry Clearance Officer:

IMMIGRATION ACT 1971- NOTICE OF REFUSAL OF ENTRY CLEARANCE

  • Fiancé’s birthday has elapsed.
  • No evidence has been submitted as to arrangements for your children’s welfare or their financial support during your proposed visit.
  • No evidence has been produced by sponsor to suggest that his landlord has consented to you living at his address.
  • The income you receive as a freelance internet blogger would still be available if you were not living here in there (Phil) and that leads me (ECO) to doubt whether you would leave the Isle of Man after the period stated.

Overall, the Entry Clearance Officer was not satisfied with all the evidence that I’ve submitted to them and he’s doubting me if I am genuine visitor and if I intend to leave the UK after the period stated.

It seems to me the Isle of Man “Entry Clearance Officer” who denied my entry clearance made a “HASTY decision – in the name of expediency”.

The reasons he cited look “FLIMSY” to me. And doesn’t “WASH”.

To rebut:

1. Fiancé’s birthday has “elapsed”

Take note that I applied for visa to enter UK on June 4th and my fiancé’s birthday was June 25th – meaning we have 21 days lead-time. Is it my fault that the UK Manila Embassy did not act within its pronounced 2 weeks visa processing time frame.

2. No arrangement for children’s financial support

It is a “given” that my fiancé will continue sending financial support during my UK proposed visit. Since this is not in the “list of requirements” I have no way of knowing there is a need to substantiate this with proof or in writing.

3. Landlord’s consent to live at address

Again, how could I know this is a requirement? If we have known, my fiancé could have obtained a written consent from the owner. (We only provide the Rent book since that’s what they required on the checklist)

“according to someone who have had applied for a visa for his gf, we don’t need permission from the landlord for me to come and visit my fiancé” when we have supplied letter from mother and copy of the rent book.

4. Income as a Freelance Internet Blogger

It is true the income she receive, as a Freelance Internet Blogger would still be available wherever she go – what is wrong with that? What is wrong with having your own source of income? What is wrong with NOT WANTING to rely on my man totally for support? It’s so UNFAIR!!! In the first place we’re not talking of huge amounts here. The income is no more than 100 British pounds monthly. In this day and age of skyrocketing cost of living, any addition to the family income goes a long way.

COURSE OF ACTION:

  1. Steve should consult an immigration lawyer to work on the reversal of the decision and provide the missing requirements/justifications as needed.
  2. If action No. 1 is not possible, work on the marriage (my previous marriage) annulment angle. Anyway, we should have done this few months ago but we wanted to try other option like what we just did, visit visa w/c it didn’t worked out. Well, everything happens for a reason. If it is not meant to be.. not meant to be!

    I know it must have been disappointing on your part but please try to take it normal and easy. t is true the reasons he cited look “FLIMSY” to me. And doesn’t “WASH”. That’s type of reasons they always give when they don’t need you.
